The terms “we,” “us,” and “our” refer to Buzzalow. Buzzalow operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience collectively referred to as the “Services.”

Buzzalow is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced in them, are collectively referred to as these “Terms of Service” or “Terms.” These Terms describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

SECTION 1 – ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence. You also represent that you have given us permission to allow any minor dependents under your care to use the Services through devices that you own, purchase, or manage.

To access or use certain parts of the Services, including browsing our online store or purchasing products, you may be required to provide information such as your name, email address, billing information, payment information, and shipping address.

We make reasonable efforts to accurately represent our products in our online store. However, colors, textures, sizes, labels, packaging, and other product details may appear differently depending on your device, screen settings, lighting, photography, and other factors.

We do not guarantee that the appearance, scent, texture, consistency, or other qualities of a product will exactly match how it appears on your screen or meet every personal preference or expectation.

All product descriptions, prices, ingredients, packaging, quantities, and availability are subject to change without notice. We reserve the right to modify or discontinue a product at any time and to limit the quantity of products available to any person, household, geographic area, or jurisdiction.

Small-Batch Product Variations

Buzzalow products are made in small batches using naturally derived ingredients. Slight variations in color, scent, texture, consistency, appearance, and firmness may occur between batches.

Products containing tallow, oils, beeswax, or similar ingredients may soften, become firmer, melt, or change texture when exposed to different temperatures. These natural variations do not, by themselves, mean that a product is damaged or defective.

Customers should store products according to the storage instructions provided on the product label or product page.

Cosmetic Use and Safety

Unless expressly stated otherwise, Buzzalow skincare products are cosmetic products intended for external use only.

Please review the complete ingredient list before using a product, especially if you have known allergies, sensitivities, or prior reactions to skincare ingredients. A patch test on a small area of skin is recommended before broader use.

Avoid direct contact with the eyes. Keep products out of the reach of children and pets unless a product is specifically labeled for such use.

Discontinue use if irritation, redness, discomfort, or another adverse reaction occurs. Seek appropriate medical attention for any serious or persistent reaction.

Individual experiences and results may vary. Information provided through the Services is for general informational purposes and is not medical advice.

Buzzalow products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. No statement made on our website, product packaging, social media, marketing materials, customer reviews, or other communications should be interpreted as medical advice.

Sun Cream

The Buzzalow product marketed as “Sun Cream” is a cosmetic moisturizer. It has not been assigned or labeled with an SPF value and should not be relied upon as sunscreen or as a substitute for an appropriately tested and labeled broad-spectrum sunscreen.

The presence of ingredients commonly used in sun-care products does not establish a particular SPF rating or level of protection against sunburn, ultraviolet radiation, skin damage, or skin cancer.

Customers should follow appropriate sun-protection practices and use an FDA-compliant sunscreen when sun protection is needed.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase the products in your cart. Buzzalow reserves the right to accept, reject, limit, or cancel an order for any lawful reason and at our discretion.

An automated order confirmation does not necessarily mean that we have accepted your order. An order is accepted when we confirm acceptance, begin fulfillment, or ship the order.

We must receive and process payment before an order is accepted or fulfilled.

Please review your order carefully before submitting it. You are responsible for confirming that the products, quantities, billing information, shipping address, and other order details are accurate.

Cancellation and address-change requests must be submitted before an order enters fulfillment. We cannot guarantee that an order can be modified or canceled after processing or fulfillment has begun.

If we reject, modify, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or telephone number provided with the order. If we cancel an order after payment has been collected, we will issue an appropriate refund.

Purchases are subject to our Refund Policy and Shipping Policy.

Unless Buzzalow expressly agrees otherwise through an approved wholesale or business account, products purchased through the Services are intended for personal or household use and may not be purchased for unauthorized commercial resale, redistribution, or export.

Approved wholesale, retail, or business-to-business orders may be subject to additional written terms, minimum quantities, pricing arrangements, tax documentation requirements, payment terms, and other conditions. If separate written business terms conflict with these Terms, the separate business terms will control for that transaction.

We reserve the right to limit or prohibit orders that appear, in our reasonable judgment, to have been placed by resellers, distributors, dealers, or other unauthorized commercial purchasers.

SECTION 4 – PRICES AND BILLING

Prices, discounts, product availability, and promotions are subject to change without notice.

The price charged for a product will generally be the price displayed when the order is placed and will be shown in your order confirmation. Unless expressly stated otherwise, displayed prices do not include applicable taxes, shipping charges, handling charges, customs duties, or import fees.

Prices offered through our online store may differ from prices offered through physical locations, social media, wholesale arrangements, special events, or third-party sales channels.

We may offer promotions governed by separate terms and conditions. If there is a conflict between the terms of a promotion and these Terms, the specific promotion terms will control with respect to that promotion.

You agree to provide current, complete, and accurate purchase, billing, payment, shipping, and account information for all purchases.

You agree to promptly update your information, including your email address and payment details, so that we can complete transactions and contact you when necessary.

You represent and warrant that:

1. The payment information you provide is accurate, current, and complete.

2. You are authorized to use the selected payment method.

3. Charges incurred through your payment method will be honored by the applicable payment provider.

4. You will pay all applicable charges, including the product price, shipping and handling charges, and applicable taxes.

We reserve the right to correct pricing errors. If a pricing error affects an order you have already placed, we may contact you for instructions or cancel and refund the affected order.

SECTION 5 – SHIPPING AND DELIVERY

All processing, shipping, and delivery dates are estimates unless we expressly state otherwise. Delivery times are not guaranteed.

We are not responsible for delays caused by shipping carriers, weather, natural disasters, customs processing, labor disruptions, incorrect customer-provided information, or other circumstances outside our reasonable control.

If we cannot ship your order within the timeframe stated at checkout or otherwise promised to you, we will provide notice and the options required by applicable law, which may include consenting to a delay or canceling the unshipped order for a refund.

You are responsible for providing a complete and accurate delivery address. Buzzalow is not responsible for delays, failed delivery, or additional shipping costs caused by an incorrect, incomplete, or outdated address provided by the customer.

If an order is returned to us because of an incorrect address, refused delivery, or failed delivery attempt, we may require payment of additional shipping charges before reshipping it, unless the problem was caused by our error.

Claims involving orders that arrive damaged, incorrect, or incomplete will be handled under our Refund Policy and Shipping Policy.

Please inspect your order promptly after delivery and contact us within the timeframe stated in our Refund Policy if there is a problem.

SECTION 6 – INTELLECTUAL PROPERTY

The Services, including all trademarks, trade names, logos, product names, slogans, text, graphics, photographs, videos, audio, product descriptions, reviews, website designs, layouts, and other content, are owned by or licensed to Buzzalow and are protected by applicable United States and international intellectual property laws.

These Terms allow you to access and use the Services solely for your personal, lawful, and noncommercial use.

Without our prior written permission, you may not:

1. Copy, reproduce, distribute, modify, or create derivative works from the Services.

2. Publicly display, perform, publish, republish, download, store, or transmit material from the Services.

3. Use our photographs, product descriptions, labels, logos, or other materials for resale, advertising, or commercial purposes.

4. Remove or alter copyright, trademark, or proprietary notices.

5. Use the Services in a way that infringes or misappropriates our rights or the rights of another party.

Except as expressly provided in these Terms, nothing grants you a license or other right under any patent, trademark, copyright, trade secret, or other intellectual property right belonging to Buzzalow, Shopify, or another party.

Buzzalow’s name, logos, product names, designs, and slogans are trademarks or trade dress belonging to Buzzalow or its licensors and may not be used without prior written permission.

Shopify’s name, logos, product names, designs, and slogans are trademarks of Shopify. Other names, logos, and marks appearing through the Services belong to their respective owners.

All rights not expressly granted are reserved.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools, features, integrations, or services operated by third parties. We do not necessarily monitor or control these third-party tools.

You acknowledge that access to third-party tools is provided on an “as is” and “as available” basis, without warranties, representations, endorsements, or conditions of any kind.

To the fullest extent permitted by law, Buzzalow will not be liable for harm or damages arising from your use of optional third-party tools.

Your use of third-party tools is at your discretion and may be governed by separate terms and privacy policies. You are responsible for reviewing and accepting those terms before using the applicable tool.

We may introduce new features, tools, and resources through the Services in the future. Those additions will be considered part of the Services and will be governed by these Terms unless separate terms are provided.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain content, materials, functionality, or links provided by third parties.

We are not responsible for examining or evaluating the accuracy, content, security, availability, policies, or practices of third-party websites or services.

Accessing a third-party website or service is at your own risk. Buzzalow is not responsible for any harm, damage, loss, or dispute resulting from your access to or use of third-party content, websites, products, or services.

Please carefully review the applicable third party’s terms, policies, and practices before engaging in a transaction. Questions or complaints regarding third-party products or services should be directed to the applicable third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Buzzalow is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Buzzalow.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Buzzalow, including any injury, damage, or loss resulting from purchased products and services.

You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Buzzalow.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify’s Privacy Policy.

By using the Services, you acknowledge that you have reviewed the applicable privacy policies.

Because the Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services in order to host, maintain, improve, secure, and provide the Services.

Information submitted through the Services may be transmitted to and shared with Shopify and other service providers. These parties may process information in countries other than the country in which you reside.

SECTION 11 – FEEDBACK, REVIEWS, AND SUBMISSIONS

If you submit, upload, post, email, message, or otherwise provide ideas, suggestions, reviews, photographs, videos, testimonials, proposals, plans, or other content, collectively referred to as “Feedback,” you grant Buzzalow a perpetual, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, modify, publish, translate, distribute, adapt, and display that Feedback in any lawful medium and for any lawful purpose, including operating, improving, and promoting our products and Services.

You represent and warrant that:

1. You own the Feedback or have all necessary rights and permissions to provide it.

2. Our permitted use of the Feedback will not violate another party’s rights.

3. You have disclosed any compensation, free products, discounts, or incentives received in connection with the Feedback.

4. The Feedback is accurate and reflects your honest experience.

5. The Feedback complies with these Terms and applicable law.

Unless otherwise required by law, we are not obligated to keep Feedback confidential, pay compensation for Feedback, or respond to Feedback.

We may monitor, edit, refuse, or remove Feedback that we believe is unlawful, false, misleading, abusive, defamatory, threatening, obscene, infringing, or otherwise inappropriate.

Feedback must not contain malware, viruses, misleading statements, unlawful content, or material that infringes another party’s intellectual property, privacy, publicity, or other rights.

You may not use a false identity or misrepresent the source of Feedback. You are responsible for the accuracy and legality of the content you submit.

Information available through the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, ingredients, pricing, promotions, offers, product availability, shipping charges, transit times, or other matters.

We reserve the right to correct errors, inaccuracies, or omissions and to update information at any time without prior notice.

We may modify or cancel an affected order if information relating to that order was materially inaccurate, including after the order was submitted. If we cancel a paid order because of our error, we will issue an appropriate refund.

We are not obligated to update or clarify information except as required by applicable law.

SECTION 13 – PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not access or use the Services, directly or indirectly:

1. For an unlawful, fraudulent, deceptive, or malicious purpose.

7. To transmit advertising or promotional material without authorization, including spam, junk mail, chain letters, or similar solicitations.

8. To impersonate Buzzalow, Shopify, another customer, or any other person or entity.

9. To interfere with another person’s use or enjoyment of the Services.

10. To engage in conduct that may harm Buzzalow, Shopify, our customers, our service providers, or another person or expose them to liability.

You also agree not to:

1. Upload or transmit viruses, malware, or other harmful code.

2. Reproduce, duplicate, copy, extract, sell, resell, or commercially exploit any portion of the Services without authorization.

3. Collect, scrape, harvest, or track personal information belonging to others.

4. Phish, pharm, pretext, spam, or engage in similar deceptive activities.

5. Use robots, spiders, scrapers, automated data-gathering tools, artificial-intelligence agents, or other automated processes to access or interact with the Services except as expressly permitted.

6. Interfere with, bypass, disable, or circumvent security, authentication, access-control, robot-exclusion, or other protective features.

We reserve the right to restrict, suspend, or terminate access to the Services if we reasonably believe that these Terms have been violated.

This section applies if you use, permit, enable, or deploy an Agent to access, use, or interact with the Services.

An Agent must not access or interact with the Services if Buzzalow has requested that the Agent stop accessing or interacting with the Services.

14.3 Access Restrictions

We may use technical or other measures to limit whether and how an Agent accesses, uses, or interacts with the Services.

14.4 Agent Requirements

Agents must:

1. Identify requests as originating from an Agent and disclose the Agent’s name in the applicable user-agent string using the format “Agent/[agent name].”

2. Not conceal or misrepresent that access or interaction is being performed by an Agent.

3. Not imitate human behavior for the purpose of avoiding detection.

4. Not complete, bypass, or circumvent CAPTCHAs or similar measures intended to distinguish human activity from automated activity.

5. Respond truthfully to requests intended to determine whether an interaction is being performed by a person or computer.

6. Not evade measures intended to block, restrict, modify, or control an Agent’s access to the Services.

SECTION 15 – TERMINATION

We may terminate these Terms or restrict or terminate your access to all or part of the Services when reasonably necessary, including if we believe you have violated these Terms, misused the Services, engaged in fraudulent activity, or created a risk of harm or liability.

You remain responsible for amounts properly due through the effective date of termination.

The following sections will survive termination to the extent applicable: Intellectual Property; Feedback, Reviews, and Submissions; Termination; Disclaimer of Warranties; Limitation of Liability; Indemnification; Severability; Waiver and Entire Agreement; Assignment; Governing Law; Privacy Policy; and any other provisions that, by their nature, should survive termination.

SECTION 16 – DISCLAIMER OF WARRANTIES

Information presented through the Services is provided for general informational purposes. It is not medical, legal, financial, or other professional advice.

We do not warrant that information provided through the Services is complete, accurate, current, or suitable for every purpose. Any reliance you place on that information is at your own risk.

Except as expressly stated by Buzzalow and to the fullest extent permitted by applicable law, the Services and products offered through the Services are provided on an “as is” and “as available” basis, without representations, warranties, or conditions of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and noninfringement.

We do not guarantee that access to the Services will be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not allow the exclusion of certain warranties or consumer rights. In those jurisdictions, the exclusions in this section apply only to the maximum extent permitted by law.

To the fullest extent permitted by applicable law, Buzzalow and its owners, members, partners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors, together with Shopify and its affiliates, will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages.

This limitation includes, without limitation, lost profits, lost revenue, lost savings, loss of data, business interruption, replacement costs, or similar damages arising from or related to:

1. Your access to or use of the Services.

2. Your inability to access or use the Services.

3. Products purchased through the Services.

4. Errors or omissions in content.

5. Content or products transmitted, posted, sold, or otherwise made available through the Services.

6. Unauthorized access to or alteration of your information.

These limitations apply regardless of whether the claim is based in contract, tort, negligence, strict liability, statute, or another legal theory and even if we were advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability that applicable law makes non-waivable.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Buzzalow, Shopify, and their respective affiliates, partners, owners, members, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from:

1. Your material breach of these Terms or a policy incorporated into them.

2. Your violation of applicable law.

3. Your violation of another party’s rights.

4. Your unlawful or unauthorized access to or use of the Services.

5. Content or Feedback you submit through the Services.

We will provide reasonable notice of an indemnifiable claim. A delay in providing notice will not relieve you of your obligations unless the delay materially prejudices your ability to respond.

We may control the defense and settlement of a claim at your expense, including the selection of counsel. We will not agree to a settlement that imposes a nonmonetary obligation on you without your consent, which will not be unreasonably withheld.

You agree to reasonably cooperate in the defense of an indemnified claim.

SECTION 19 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law.

The unenforceable portion will be deemed severed from these Terms, and the determination will not affect the validity or enforceability of the remaining provisions.

Our failure to exercise or enforce a right or provision of these Terms does not waive that right or provision.

These Terms and the policies or operating rules posted through the Services constitute the entire agreement between you and Buzzalow regarding your use of the Services.

They supersede prior or contemporaneous agreements, communications, negotiations, and proposals relating to the Services, whether oral or written.

Any ambiguity in these Terms will not automatically be interpreted against the party that drafted them.

SECTION 21 – ASSIGNMENT

You may not assign, transfer, delegate, or otherwise dispose of these Terms or your rights or obligations under them without our prior written permission. Any unauthorized attempted assignment is void.

We may assign, transfer, or delegate these Terms or our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, change in control, or operation of our business, subject to applicable law.

SECTION 22 – GOVERNING LAW

These Terms and any separate agreements through which we provide the Services will be governed by and interpreted under the laws of the State of Texas, without regard to conflict-of-law principles.

Except where applicable law permits or requires otherwise, legal proceedings relating to these Terms or the Services may be brought in a court of competent jurisdiction located in the Texas county in which Buzzalow maintains its principal place of business.

Nothing in this section prevents either party from bringing an eligible matter in small-claims court or exercising rights that cannot lawfully be waived.
